2 and a half litres, I've only had to put half a pint recently. Also about 2weeks ago I ran out of fuel at nite and left it till the next mornin, put fuel in and it wouldn't start, I thought the carbs sucked in dirt so I put some easy start and carb cleaner and it started, its actually since then its been giving me trouble. Before that it was running strong. Do u think from flipping during the accident couldve caused the fuel/oil to mix?

Drain the oil if there's more than you put in then yes it's got fuel in the oil. If that's the case flipping the bike running it dry may have upset the carb float valves . Have you tried sourcing the oil leak? There is an oil seal behind the gearbox sprocket the gearchange shaft and clutch pushrod but if it's making noises probably too late due to low oil or contaminated oil.

Got up this morning, started it and no change. Decided to spray carb cleaner in and its smoking a lot but sounds right. I lit the dipstick to see if it would ignite the petrol but it didn't. Could the jets be blocked? Anyways not gonna take a chance, gonna do a oil and oil filter change

So, you've lost half a pint of oil in 500kms? I've done 70000kms on my NC35, and I've never had to put a drop in between changes. There's a minute weep somewhere around the gearbox sprocket, but it's not serious enough to cause a noticable loss of oil, it just puts a smear over the bottom of the fairing and there are usually a few drips on the sump. Maybe you didn't put quite enough in when you did the change, but if it's covering everything significantly, then you have a proper leak and need to fix it.
As for the crappy running, I presume when you say you ran out of fuel you mean completely drained the tank at which point the float bowls would have emptied too. In theory, there shouldn't be any crap getting to the jets as there is a filter on the fuel tap and a filter in each carb (at least, there are on the RVF carbs), so if your carbs are dirty, it may well be that the few drops of fuel left after you ran out have evaporated, and left behind all the nice additives the fuel companies put in. You might get away with some carb cleaner, however you might find they need stripping and cleaning thoroughly.
Given the fact you've flipped the bike, you cannot rule out having done some unseen damage somewhere, depending on what happened when it flipped. Did the engine stay running or did it stall? Did it tweek the throttle and rev hard when it landed? Worst case scenario for bikes is probably ending up with the engine on it's side or inverted and running, especially revving high. The oil isn't going to be where it should, and you can end up with damage to the internals. For now, I'd do that oil change, or at lest see how much comes out to determine if you've lost any/lots (filter accounts for 100ml allegedly) and clean up the carbs. I'd not spend lots of time and money on it until this has been done so you can tell if it's still got a problem or not. If it's still making odd noises with the right amount of fresh oil and carbs clean, maybe take a look at the valve clearances, but to be honest, if it wasn't making odd noises before you crashed it, then it's probably not a coincidence, and running out of fuel is probably not the cause.

I don't have the fuel filter. I just opened up the left crankcase and there was a pool of oil. I cleaned it out and it seems ok, bit its still smokin a little dunno if thatts from the carb cleaner, I have a feelin they are blocked up and not set properly as the last guy that set everythin stuffed up a lot of parts. There's still a soft tick. I can't remember if the bike stalled as I was F**ked, cracked my pelvis and ribs.

The fuel filter is built into the fuel tap, it's inside the tank. Unless someone has removed it from the fuel tap, of course...

I know somebody did remove it. Just drained the oil it was about 2.25 litres. Very thin.

If the oil was thin, and you changed it 500 kms ago, did it smell of petrol? If so, you probably have a stuck float valve in one of the carbs, and the fuel tap may not be shutting off properly. You need to fix that, as thin oil will hurt the engine, and it's not out of the question that you could completely fill the engine with petrol, and that's a disaster if you try and crank it....
