I expect its just the style of the bars they are butted up even if there is a locating peg underneath and as long as the bars are correctly tightened so they wont move they could be further down if needed.
With clearance issues make sure you can turn lock to lock without any fouling, cables not stretching and no pinch points, as it may come up in the MOT if there is any issues there. I have heard of an MOT tester failing a 29 due to a pinch point on the standard set up, just as the bar was on full lock and the end was close to the air scoop. So any mods may be scrutinised.

Firstly, thanks for all the replies, secondly here is a bit of an update...
So i lowered the front end and as I stupidly don't have a paddock stand you''ll have to excuse the way in which I have done this; there is nothing pretty nor mechanically minded about it.
Got the old clips on off and put the SV ones on, they were a reasonably tight fit down the stanchion which was good. I had to remove the locating peg on them as they wouldn't sit flush under the top yoke.
The problem i had / am having is that when i tighten up the pinch bolt on the new sv650 clip ons the bars still move around? I've tightened it as much as i can but nothing will get them to lock to prevent sideways motion.
SV650 forks are 41mm as are my CBR's and they fit snug on the stanchions so i can't understand why they won't tighten up.
Any ideas?!

So, just putting it out there. I seem to have used the bolts from the CBR clip-ons on the SV650 clip ons. Didn't really pick up on it at the time as they fitted in and went tight but just thinking could it be that?
I can't see how a bolt would affect it as surely any bolt providing it doesn't cross thread and tightens up would do the trick for pinching?
Or am i missing something??

The Sv650 clip-ons should tighten up nicely on the forks - both have the same diameter stanchions.
Might be worth taking them off again and cleaning the area where they clamp the forks to ensure there isn't anything holding them off the forks. Other than that, I can't see why they aren't clamping up.

That was my thinking and i was quite stumped when they were still loose?
A bike friend has mentioned that removing the tab from the sv650 clip ons means they won't be able to sit like the original ones as this helps them stay still?
As far as im concerned the tab or locating pin is surely just for making sure they're in the right place? what holds them in place is the pinch bolt?
The 'chinese' ones came through yesterday and although they look 'fancy' i'd rather use the SV650 ones because
A. they are a higher lift
and
B. they look OE and considerably stronger than something knocked out for 50p....

I'd take them off pinch them up off the bike (do the same with the original bars) and use a digital vernier to check they are the same as it sounds to me like the SV ones are larger even though the specs say they are the same.
Also looking at the last pic even though you currently have no clearance issues I think you are going to struggle once you have fitted the brake res.

It looks like those bars are going to need that locating peg as some do. Maybe its down to just having one bolt to tighten up and your at the clamp limit. I know someone who built a old school cafe racer and his bars are very low, not butting up against the yoke or peg but in his instance the bars were held with two allen bolts each side, sadly i wont see him until April but maybe you could search around cafe racer build forums for some help.

You could try lightly filing between the pinch bolt so you can tighten it a bit more?
