Fair Fairing
A week or so ago I bought a pair of 3TJ fairing lowers. Mine have some scratches which have gone through the graphite grey stickers low down so I wanted some with the stickers intact.
I saw these http://cgi.ebay.co.uk/ws/eBayISAPI.dll? ... TQ:GB:1123 they looked ok and I can give them a polish after I'd bolted them on. They were on a Nearest Offer so I offered £50 (you can see it's added to the auction) he countered with 60 so I went 55 but it was refused. The nearest offer was taken off. I waited a bit, offered 60 and was asked to ring him and paid by card.
All was not well when I got them. The packing box was old, "squidgy" and when I unpacked it no bubble wrap just a piece of card to separate the fairings. They were really dusty too which hid a lot of surface scratches, they looked like storage scratches. Then there was a scratch on each fairing that was through the paint and into the (white) plastic. I was gutted. Rang him up to send them back ... now I'm a "Bad Buyer"

Paying by card was a mistake bud. You can't even claim through eBay now.
Conventional wisdom says to know your limits. To know your limits you need to find them first. Finding your limits generally involves getting in over your head and hoping you live long enough to benefit from the experience. That's the fun part.

Just have general fair wear and tear as one would expect on a used bike.

which they clearly do,
so under distance selling rules, ie internet,
not fit for purpose and not as described
under distance selling rules, you should have a 14 day grace period to just send em back whatever and get a refund,
but as they were not as described you should get the postage as well and any other costs

Innit - right now I'd accept just the cost of the panels but if it gets difficult I'll claim the lot.
I could also tell e-bay about selling them without paying fees, they'd close his account for that.

He receided the fairings back but isn't going to refund until he has to under the Distance Selling Laws, despite it saying "as soon as possible" he's going for the "In any case within 30 days" ...
Good thing is the Act says the refund should be including the delivery costs.
I'll wait till after my top fairing sells on e-bay before reporting him.
